CANCELLATIONS

If you need to cancel a dog walk, you must call at least three hours in advance of the scheduled arrival time. If we arrive at your home and cannot gain access, your pet is not at home, or you have not given sufficient notice of cancellation, you will be charged for the full amount of the scheduled walk.

Due to high demand for our pet sitting services, particularly during the holidays, cancellations are very critical to our scheduling. Because of this, any cancellations for pet sitting services must be made at least five days prior to the first date of service to avoid a charge. Cancellations made less than five days prior to the first visit will be subject to a charge equivalent to 50% of the charge for the scheduled visits. If less than 24 hours notice is given, you will be charged the full rate.

All that being said, we do understand that emergencies happen. We may, in our absolute discretion, agree to waive any of the cancellation fees referred to above where there are extenuating circumstances.

 

SERVICES AND PAYMENT

We will provide dog walking and/or pet setting and/or pet taxi services to you at times agreed between you and us from time to time. Services will be provided by Paws On The Move, including its employees or contractors. These Terms and Conditions will apply to all future services provided by Paws On The Move to you.

You must pay the fees for our services at the rates that we advise you from time to time. Rates are subject to variation. We will inform you of any increase in our rates prior to charging you for services on the basis of such increased rates.

Payment for dog walking services is due prior to the walk. For regular, approved clients, payment is due at the end of each week for services accrued. For pet sitting services, full payment is due before the first scheduled visit. For pet taxi services, an invoice will be sent outlining the total time taken for the taxi service and will be charged according to the published rates. This invoice is due one week after services have been rendered.

We accept cash, cheques (made payable to Diana Russo t/a Paws On The Move) and EFT. Bank details are as follows:

SECURITY

Our walkers and sitters have up to date police checks and public liability insurance.

For Paws On The Move to conduct pet sitting services, we require you to provide us with a copy of your house and/or gate key. For dog walking, a key is preferable; however, if this is an issue, then your dog must be kept in the backyard and access must be available via an unlocked gate. It is the owner’s responsibility to ensure this gate is well secured to prevent any unwanted escapes!

If upon entering and leaving your premises any security concerns come to our attention, we will attempt to notify you immediately of any such concerns.

 

ILLNESS OR INJURY

If your pet falls ill or is injured during the time it is under our care, Paws On The Move will take all reasonable care in the circumstances.

In the event of illness or injury of your pet, if circumstances reasonably permit, we will attempt to make contact with you on the numbers provided to obtain your approval and guidance regarding your pet’s illness or injury before taking any action. In the event of an emergency or if we are unable to make contact with you, we have the right, but not the obligation, to obtain advice of your nominated vet, or another vet should yours be unavailable, and give instructions to such vet to proceed with recommended treatment for your animal.

We may require that you pay funds to us in advance to our nominated bank account to cover us for anticipated vet fees or associated costs. Further, you authorise us to incur any vet fees or associated costs we deem reasonable. We may, in our absolute discretion, but we are not obliged to, incur any such vet fees or associated costs. If we do so, you must reimburse us for those fees and costs within two business days of receiving a request for payment.

We request that you notify your vet that Paws On The Move is caring for your pet and it is your responsibility to ensure that adequate insurance is in place for your pet. Paws On The Move recommends RSPCA for pet insurance.

 

YOUR PET’S HEALTH AND SAFETY

YOUR PET’S HEALTH AND SAFETY

At Paws On The Move, your pet’s health and safety is always our first concern. With this in mind, we would like to make you aware of the following:

In extreme weather conditions, that is, heavy downpour, thunderstorms or extreme heat, we will not walk your dog and will endeavour to delay or bring forward the walk, cancel the walk or alternatively the walk will be rescheduled for another day.

Except as follows, Paws On The Move will always walk your dog on a lead. If you request your dog to be taken off the lead, and Paws On The Move agrees to that, we will transport your dog to the nearest designated council-approved “off-lead” area to run around. Transport time will be an additional charge if it amounts to more than 15 minutes return time in the car. This service is only available for those dogs that have previously been off the lead in parks (not footpath) and if Paws On The Move has assessed it to be safe for your dog, the walker, other dogs and people to do so and the behaviour of your dog is likely to be reasonable while off-lead.

Your dog MUST have a collar and council tag attached to the collar (it is council law that dogs and cats are registered).

Paws On The Move is trained in pet first aid and always carries a pet first aid kit in the car.

Paws On The Move reserves the right to refuse service to an animal that displays aggressive tendencies.

 

INDEMNITY, RELEASE AND LIABILITY EXCLUSION

You hereby indemnify, on demand, Paws On The Move and any of its officers, employees or agents against any and all claims, demands, actions, proceedings, suits, losses, costs or expenses incurred or sustained by any of them that arise from services provided by Paws On The Move for your animal, including, without limitation, arising from death or personal injury, property damage or death of or injury to the other animals caused by or contributed to by your animal.

To the maximum extent permitted by law, you hereby release all claims against, and agree to exclude all liability to you of, Paws On The Move and any of its officers, employees or agents, for negligence or other breach of duty arising out of the provision of services for your animal. Any liability of Paws On The Move for breach of this agreement is capped at the amount of fees paid for the service or services provided in connection with the breach.

 

PRIVACY STATEMENT

During the “meet and greet” consultation, Paws On The Move will ask you to complete a form containing your personal details, emergency contact numbers and your vet’s details.  This information will be kept with your walker/sitter at all times.

Your keys will not have any personal details attached and will be kept separate to all your personal information.

Any information you provide to Paws On The Move will be kept confidential and will not be shared, sold or exchanged with any businesses or individuals not associated with Paws On The Move.

 

TERM AND TERMINATION

This agreement continues until terminated by Paws On The Move or you.

We may terminate this Agreement at any time on one day’s notice. However, we agree not to terminate the Agreement during the course of a service unless Paws On The Move determines that your animal is posing an unreasonable risk of injury to other animals, persons or property damage.

You may terminate this agreement at any time on one day’s notice.

You will remain responsible for payment for our fees and charges, which have fallen due prior to the time of termination, and for services provided up to the time of termination. No refunds for fees and charges already paid will be provided by Paws On The Move unless there are extenuating circumstances.

 

INTERPRETATION

In these Terms and Conditions:

  • a reference to “you” or “your” is a reference to the client who has engaged Paws On The Move under this agreement;
  • a reference to “we”, “us”, “our” or “Paws On The Move” is a reference to Diana Russo trading as Paws On The Move.

This agreement constitutes the entire agreement between the parties regarding the matters set out in it and supersedes any prior representations, understandings or arrangements made between the parties, whether orally or in writing.

This agreement is governed by the laws of Victoria. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Victoria.

If any clause is in any way unenforceable, invalid or illegal, it is to be read down so as to be enforceable, valid and legal. If this is not possible, the clause (or where possible, the offending part) is to be severed from this agreement without affecting the enforceability, validity or legality of the remaining clauses which will continue in full force and effect.
